This Privacy Policy describes how OpenHeight LLC ("OpenHeight," "we," "us") collects, uses, and protects information in connection with the OpenHeight service available at app.openheight.com, including text message (SMS/MMS) and email communications sent through the service on behalf of the local service businesses that subscribe to it ("Business Subscribers"). This policy also covers information submitted through this website.
Who we process information for
OpenHeight provides communication tools to Business Subscribers. When you call, text, or submit a request to a business that uses OpenHeight, we process your information on that business's behalf so the business can respond to you. Your relationship is with the business you contacted; OpenHeight is the service provider that makes the conversation work.
Information we collect
From consumers who contact a Business Subscriber
- Phone number and call metadata (caller ID, time of call, and whether the call was answered), when you call a business's number.
- The content of text messages and photos you choose to send, including job descriptions and scheduling preferences.
- Name, email address, and service address, if you choose to provide them in a message or request form.
- Opt-out and opt-in events (for example, replying STOP or START).
From Business Subscribers and their staff
- Account information: name, email address, business name, business phone numbers, and staff mobile numbers registered for use with the service.
- Business configuration such as review links and message preferences.
How we use information
- To send a response when a call to a Business Subscriber goes unanswered, and to collect the details of your request for the business.
- To deliver messages between you and the business you contacted.
- To send a review request on a business's behalf after a completed job, where permitted.
- To honor opt-outs, maintain consent records, and comply with telecommunications and consumer-protection law.
- To operate, secure, and improve the service.
Text messaging and information sharing
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are not shared with, sold to, or transferred to any third party for any purpose, excluding vendors and service providers acting on OpenHeight's behalf solely to deliver the service (for example, our telecommunications carrier). All other use-case categories exclude text messaging originator opt-in data and consent.
We share information only:
- With the Business Subscriber you contacted, so they can respond to your request — this is the purpose of the service.
- With service providers that operate the platform under contract (telecommunications carrier, cloud hosting, and email delivery providers), solely to provide the service.
- When required by law, legal process, or to protect the rights and safety of users and the public.
We do not sell personal information, and we do not use personal information for third-party targeted advertising.
Opting out
Reply STOP to any text message to immediately stop receiving texts from that business through OpenHeight. Reply START to resume. Reply HELP or contact support@openheight.com for assistance. Opt-outs are recorded durably and honored even if your request or job record is later deleted. Emails sent through the service include an unsubscribe method.
Data retention
We retain conversation records for as long as the Business Subscriber maintains an active account and needs them to serve their customers, and as required for legal and compliance purposes. Opt-out records are retained to ensure your preference continues to be honored.
Security
Information is stored with access controls that isolate each business's data, encrypted in transit, and accessible only to the business you contacted and to OpenHeight personnel who need it to operate the service.
Your rights
Depending on your state of residence (including rights under the Colorado Privacy Act), you may have the right to access, correct, or delete personal information. Contact support@openheight.com and we will respond, coordinating with the relevant Business Subscriber where they control the data.
Children
The service is intended for use by businesses and their adult customers and is not directed to children under 13.
Changes
We will post any changes to this policy on this page with an updated effective date.
